U.S. Rep. Jerry McNerney (D., 11th District) has introduced a bill to stop outsourcing by cracking down on what he calls “tax loopholes” that encourage companies to move jobs abroad. It would also help ensure that corporations with government contracts do not ship jobs overseas.

“Tax dollars spent from this government should create jobs in this country, not overseas,” McNerney said.

The bill, H.R. 5622, directs the Secretary of the Treasury to establish a list of “corporate tax haven countries” and then increases civil and criminal penalties for corporations guilty of a variety of illegal transactions involving a tax haven country, such as fraud, false claims and tax evasion. A 2008 study by the Government Accountability Office (GAO) estimated 83 out of the 100 biggest public corporations have subsidiaries in tax haven countries or similar jurisdictions.

H.R. 5622 would also penalize companies with government contracts that used outsourced labor. Company officials who lie about whether they’ve outsourced jobs would face penalties up to the amount of the contract they’re seeking, and would be banned from doing business with the government for two years. Money generated by the bill would be used to pay down the country’s debt.

“Right now, when we’re having high unemployment it just makes sense for us to look at how to keep jobs in this country,” McNerney said. “The statistics show that Silicon Valley has lost 100,000 jobs over the last 10 years.”

The bill, known as the “Stop Outsourcing and Create American Jobs Act of 2010,” requires federal agencies to request information about corporations’ outsourcing practices when applying for government contracts. It also allows preference for contracts to be given to companies that have not outsourced jobs in the last year.

“One thing I hear a lot about over the last four years is people concerned about outsourcing,” McNerney said.

He noted that he’d recently heard from constituents who’d lost jobs to the overseas market, including one woman who trained new employees from Brazil, then was laid off, with her job likely going to one of the new employees she’d trained. Another lost his job to outsourcing and found another job — only to lose it when that job was outsourced, too.

The Brookings Institution estimates that by 2015, the San Francisco and San Jose metro areas will lose up to 4.3 percent of their jobs to outsourcing. An estimated 3.4 million service jobs may be outsourced overseas by 2015, in addition to the extensive job losses that have already occurred in the manufacturing sector, according to a report from the Congressional Research Service, a non-partisan feature of the Library of Congress.

The bulk of the jobs lost so far have been in manufacturing, office support, computer programmers and software engineers, medical transcriptionists, paralegals and technical writers, many of the same types of jobs for which Silicon Valley is known.

It’s early in the life of the bill, but McNerney expects to get some backing.

“I’ve got a couple of co-sponsors so far,” he said. “I suspect we’ll see more support for this in the next few weeks. I’m going to push hard on this because I want to see outsourcing reduced and I want to see American jobs increase.”

  3. The best way to encourage companies to not outsource is to encourage a friendlier business climate so that companies aren’t forced to ship jobs overseas in order to make a profit. Unfortunately, Jerry and his lefty ilk are too busy passing bills to control companies and company profits to see the big picture as to how to grow companies and create jobs. Hoping you enjoyed your one term and all the lifetime benefits you’ll be stealing from the taxpayers. See you at the polls.

    McNerney should wake up and realize we are in a Global Economy.

    Why pay someone $80 per hour to put hubcaps on cars when you can do it cheaper elsewhere? Oh, the unions support you?

    McNerney: You aren’t accountable to the unions … you’re accountable to the citizens. We’ll remind you in Novemenber.

  9. Not sure how this abolishes capitalism and the free market? Making tougher penalties for “illegal” loopholes? Allowing a public agency to give “preference” to companies that have not outsourced? I can’t find anything in the bill REQUIRING agencies to use companies that have NOT outsourced- it seems to just allow for asking for that information to be collected and used in the decision making process – (and to allow penalties for those that lie about it)(http://thomas.loc.gov/cgi-bin/query/z?c111:H.R.5622🙂 So exactly how does this ruin the free market system?

  12. The congressman is in a desperate mode since his townhall mtg last month at the Danville library. The mtg that was micromanaged to eliminate any negative comments airing to a large group. Has the congressman “remembered” if he STOOD for Mexican president Calderone after el presidente bashed OUR country in congress during his recent visit????? Vote mcinerny OUT in November—-maybe he can get elected in Mexico.

  13. I have no problem with McNerney’s proposal to increase penalties on tax cheats, but let’s not kid ourselves. Most U.S. companies are not tax cheats.

    This article would lead you to believe that 83 of 100 biggest corporations are using tax haven subsidiaries in order to engage in fraud, tax evasion, etc. and that simply is not true.

    The reason why U.S. companies use tax haven subsidiaries is because that puts them on equal footing with their international rivals. Nearly every country has tax deferral for foreign subsidiaries’ earnings.

    McNerney’s not proposing that we end U.S. tax deferral, of course. He’s just saying the Fed. govt. should hire companies that don’t outsource. My problem with that is, if it costs the federal govt. more money to hire only companies that don’t outsource, is that a smart use of public money? Shouldn’t the govt. try to save money whenever possible?

    My question for McNerney is, are companies outsourcing just to destroy U.S. jobs? Or are they trying to survive in an ultra-competitive global market? If so, why punish companies for just trying to survive?

  18. The way to stop outsourcing is to make it more economically attractive NOT to outsource.
    Of course that takes creative legislation not just lock -step punitive legislation. McNerney
    and his fellow travelers have lost sight of the simple fact that American Industry and the free enterprise system (they so dearly love to denigrade) are what made America great!

    Whether McNerney leaves office in January ’11 will be a test of how intelligent….. or how ideologue….. are the voters of this Congressional District.

    It was great seeing you at the Danville 4th of July parade. When all of your minions came by offering us in the crowd your campaign buttons and stickers, nobody took them (except the little kids who were taking things from anybody).

  21. Mr. Geisler….well , if you are going to call me out specifically I will be happy to provide additional detail. I just had surgery to implant a cataract lens at San Ramon Regional Med Ctr. The “billed charges” at SRMC for my 45 minute procedure was $21,416.00. My insurer, United Healthcare, had previously negotiated an acceptable rate for a procedure of this sort with Tenet Healthcare (the owners of SRMC) to be a sum of $6,250.00 and as a result my 20% co-pay portion was $1,250.00. Had I been one of the ones unfortunate enough to not have coverage I would have been on the hook for $21,416.00. Perhaps I would have been “uninsurable” if my wife had a pre diagnosed condition of breast cancer, or I had a child with a chronic illness. The Providence Healthcare system in Oregon is being sued for this predatory cost shifting but they are obviously not alone, it is “de reguerre” in healthcare. I am an experienced healthcare exec on both the device, provider and payer side so I know what I am speaking of. Obama’s effort to finally bring past Presidents Nixon, Ford, Bushes, and Clinton past desire for healthcare reform over the goal line is a big improvement. Universal coverage, high risk pools etc…
    Moreover, what I find particularly egregious is that you are (were) a YMCA Board member and you remain silent on where our money went in local fundraising efforts. I bet it made you feel great to be selected for the board but you really dropped the ball for your community in the end amigo.
    Lastly, my issue was with the relentless knee jerk negative reactions of the Tea Partiers…it reminds me of the journalist Hunter Thompson training his dog to snarl and hiss every time he said “Nixon”….the childish “He’s a Bum”…..”Check out moving companies” is similar. November is months away, do we have to see this every week? A civil discourse is a better means to communicate
    the opposing view and at least wait until October for goodness sake.
