Danville teen pleads guilty to rape, sentenced to six years in prison

Sam Nesis pleaded guilty today to one felony count of raping an intoxicated person and a second felony count of oral copulation on an
intoxicated person in exchange for the six-year sentence.

There is ABSOLUTELY no justification for rape, but does anyone but me wonder about a drunk 14 year old? While she certainly did not "ask" to be raped, I don't see any indication that she was forced to drink, and place herself in this situation.

Truly sad. I hope the boy gets the help he needs, as does the girl for this traumatic ordeal. I did wonder, as well with the previous comment, about the 14-year-old being drunk.

Seems like he still got a fairly light sentence for 2 felonies, although a kid from Danville who raped a minor may have a tough time in prison. I wonder if area citizens would have the same sort of thoughts about "hoping that he gets the help he needs" or "why is a 14 year old drinking" if the perpetrator was from some low income neighborhood.

When I was 19 we had Boones Farm Strawberry Hill. Soda pop with alcohol, in other words. The girls of all ages loved it and we gladly supplied it. Never raped anyone, though. Just walk down the liquor aisle at Safeway and you'll see - I think I saw a commercial the other night for marshmallow flavored vodka. While I'm at it - I am amazed at how many young people are smoking too.

Don't blame the victim! This is not his first offense, this man is a predator. From the CC Times: Still unresolved is a juvenile court case against Nesis involving a second girl he is accused of sexually assaulting when he was still a minor. That girl came forward to police after news broke of Nesis' arrest in February. The judge Tuesday ordered him to pay restitution, which includes therapy costs, to both girls. He also is required to register as a sex offender for the rest of his life.

Im a close friend of Sammys. We went to high school together and everyone loved him. this whole case is extremely one-sided and unfair. This girl gets no penalty for perjury?? Sammy can be a mean guy sometimes but he is not a rapist! You stupid Danville and Alamo parents don't know how many guys in high school get girls drunk to hook-up with them. I can GUARANTEE it's the majority of the guys at any high school. girls are dumb for not watching out for themselves. and yet Sammy has drunk sex with a girl and gets 6 years in prison? I hope that this girl cannot live the rest of her life with the guilt on her shoulders of ruining a young mans life. I love you Sammy, stay strong buddy

For all you idiots, that second case of Sammys is a girl he hooked up with when he was 17 and the girl was 15. It was completely consensual. The D.A. Is charging sammy of that crime and NOT THE ACTUAL GIRL HERSELF

HE PLEAD GUILTY if he was so innocent then why did he ask for a plea deal twice? You do not know the story of what happened. This is his second victim how many victims does it take for you to understand that he's a serial rapist. Obviously you don't know him he is sick in the head and he will get his in prison. She did not even know him and was wearing a sweatshirt and hoodie and isn't from Danville. If anything she is one of the most self cautioned people and does not show any skin. There are kids way younger then her drinking and doing worse things. Like any of you didn't drink when you were younger. She had just started drinking and stopped after the horrific incident. Not just him but the people that are backing him up are sick in the head and need a reality check. How could it be off sided? HE PLEAD GUILTY.

Derek, I actually have a younger sister and they are great friends! Sammy used to come over all the time, she loves him.

Anonymous: your an idiot. Do you know the court system works in America? SAMMY WASN'T GIVE A CHOICE! They gave him a plea deal because if he went to trial and lost, he could get up to 40 years. And the jury duty would be filled with ignorant Danville and Alamo parents. You think they would give sympathy to an alleged rapist? don't talk about things you don't know anything about.

People change where i used to live i was friends with someone and he did something people change he is sick in the head and needs to get his time for what he did to these two girls ! He's just gonna go back to doing the same thing. The question is whose next?

Sam Nesis deserves to be where he is for the crimes that he committed. He plead guilty because he is guilty. That says it all. Even the Judge after reviewing all the evidence, was compelled to classify him as a predator. That speaks volumes and should stop the mouths of all those who presume they know the facts or the truth in this case or try to lay blame toward the victim. If true to form, he will repeat this type of behavior again once loosed into society. Beware, be very aware. This time he received leniency and mercy because of his younger age. The next time it will be 40 years or life. Three strikes you are out!

School friend, you prove yourself to be a liar! If you are such a knowing and good witness why didn't this coward friend of yours go all the way with a trial? No one made him take a plea. He lies, you lie. Two birds of a feather that stick together. The real "Sammy" is guilty and plead to that because he was afraid he just might get what he deserved, 40 years. A coward through and through that preys on young vulnerable girls. The Judge called it right after reviewing the evidence.

You guys don't know how a court trial works obviously. It's gambling with your life. Your putting your future into the hands of 12 randomly selected people called the "jury". "You have preyed on at least two vulnerable individuals in such a way that it causes great concern," Judge Clare Maier said in Contra Costa County Superior Court today.

Last month, the judge heard comments from the victim in the case, who is now 15 years old.

Maier said those words moved her and in addition to other allegations against the defendant, caused her to reject a three-year sentence in exchange for a guilty plea proposed last month.

Maybe if "schoolfriend" was there that night as he claims (or maybe "he" is really Sammy's mommy) perhaps the court system missed prosecuting him as well. There's always next time.

This whole entire case was a " he said, she said case" you all don't know the details but the truth is that there was no evidence that Sammy did it.

Also, why do you think Sammy got such a short sentence? The DA knew that this girl was lying about forcible rape. they first offered him 1.5 years and now hes getting 3 years

Sam Nesis was never offered 1.5 years. The first plea was for 3 and the Judge halted that. He plead to 6 years, not 3, School Friend. Is your reading as poor as your grammar?

I am someone who is well aware of the details of this case and there is plenty of hard evidence to put this guy away. The victim was taken against her will after two other girls from Danville/Alamo had been dropped off at their homes. They knew Sam Nesis, the victim did not. She had never met him before in her life. So this was not a date rape or drunk consensual sex. The victim's BAC wasn't even over the legal limit. She was wearing jeans, sweatshirt and Uggs boots. (Wouldn't say that is a sexy get up would you?)

The assault began on the freeway and ended up at the back of the BART station parking lot. She was repeatedly assaulted and restrained for quite a period of time. The first thing he did was take away her phone and pulled out the SIM card. She was held down by her hair and forced to commit oral copulation while he was yelling over and over "Gag, b***h, gag." Then she was raped and sodomized repeatedly. She had multiple contusions over her body and scalp and chunks of missing hair. He brutalized her in every way imaginable while threatening her and keeping her against her will. When he was finished she was pushed from his van and run down like an animal. Those are the facts you will find in evidence, and are public record, School Friend! There are rrefutable and backed by the rape kit and pictures. Now that is some kind of mean friend you have. He is a monster.

Also, you do not know the victim, nor did she know Sam Nesis. She had accepted a ride home from a friends birthday party along with two other girls. The party was over at 11:00 p.m. Nobody else at the party knew him either, including the parents who chaperoned it. The two girls who were dropped off before the victim were able to identify him. They were identified from pictures on Facebook. Apparently at least one of them knew him and gave the police his name.
That is how Sam Nesis was caught. After an APB was put out on his vehicle, the CHP arrested him the next evening in Monterey. Hmmmm....wonder why he fled town?

Sam Nesis purposely did not drop the victim off first, because he knew exactly what he was going to do. She even told him he had driven by her exit before he took the other two girls home. He is a sick monster and predator and deserves the 40 years. If there is no evidence why did the Judge up his bail from $300,000 to $500,000? Exactly, there was plenty of evidence to bind him over to trial.

If anything, the victim has been vilified. The worst thing she did was to make a wrong judgment call that night to take a ride home with this predator. She is the one who has received a life sentence. If you have never been raped or sexually assaulted, you wouldn't have a clue. She should be applauded for going to the court and demanding that her voice be heard. Too many young girls and women don't for exactly the reasons why ignorant people like School Friend here are posting. This is a most egregious, traumatic and heinous crime, not drunk consensual sex. The guy is a MONSTER AND PREDATOR. No one is safe around him. HE is a repeat offender already. Even the Judge said she had reason for GREAT CONCERN because he had PREYED on AT LEAST TWO vulnerable individuals. She said this AFTER LISTENING TO AND REVIEWING ALL OF THE EVIDENCE.

If you care about your daughters DO NOT EVER LET THEM AROUND THIS PREDATOR.

Hopefully, this will now stop everyone from speculating about things they know nothing about, including most of all, School Friend.

Your welcome, Carolyn. Hopefully, the fact that the Judge in this case did hear the victim will give her more confidence going forward.

By the way, it is virtually unheard of and extremely rare in the criminal justice system for a judge to turn down a plea deal. It is even more rare that the perpetrator would be forced to take a heftier plea deal or else face going to trial. There was certainly enough evidence in this case to go to trial and probably get a conviction on more than the 2 charges here.(He was originally charged with 5 felonies.) If anything, it is usually the victim that goes on trial, however, through dirty, underhanded tactics of defense attorneys.

I saw a 9-year old victim of sexual assault virtually get ripped apart by a defense attorney while she was under testimony. That is another reason why many of these cases get offered as plea deals, because it is a difficult thing to have their life and the sordid, humiliating details of the incident paraded in the public eye. Also, there usually are no other eye witnesses because perpetrators like this work under the cover of dark or behind closed doors. They ALWAYS say it was consensual. They are very deceived about themselves and are usually sociopaths and "charming" individuals. That's why many people think they are "so wonderful". Ted Bundy is a good example of a rapist turned serial killer that had a charismatic personality and good looks, but was a sociopath and deviate to the core. Many of these types start their criminal behavior at a young age, i.e., in their teens, as has Sam Nesis done with two known victims.

If his friends and family truly love him they will need to come out of denial and get him help. Unfortunately, there is usually not a cure for such a person.

The facts in evidence speak the truth. You didn't know your good buddy won't be getting out in half time either? He will be required to serve at least 2/3 of his sentence, take 2 strikes,register as a sex offender for life and serve a mandatory 3-5 years formal probation. He also has other charges pending and will have to pay restitution.

You are a very crude individual School Friend. Sounds like you are the one in need of life and a new friend. Living in denial will never help you or your good buddy.

One other thing, School Friend, it is a well known fact that offenders such as your good buddy will not be received too kindly by other prisoners, especially at San Quentin where he is headed. Instead of being the predator, he will now be the one being preyed upon. They just love to teach guys like your friend a few lessons. Perhaps that is the true justice... You reap what you sow. Neither will mommy, daddy, money or school friends be able to save him at his new home. Every day will seem like a hundred years to a spoiled kid from Danville.

If there was a popularity contest in jail, Sammy would win hands down. Social skills help out in life. And I'll let you know once hes out, should be about 3 YEARS from now.....

You are just wasting your time responding to School Friend. The fact that Sam Nesis and probably School Friend went to Del Amigo explains a lot about the behavior of these two individuals. They obviously could not function in a normal high school setting which also may be the case with regard to real life. There are many Del Amigo graduates who do just fine, but they are put there initially because there is a problem which may or may not be corrected. Obviously with Sam Nesis, it did not get corrected.

That this girls gets the help that she needs ( Her parents should have picked her up from the party!!!!!!) and that this Kid get the help that he needs. ( If his crime was as Bad as stated he would Not have gotten only 3 years)
trust me I work in the system, there are so many things going on, that you all only know 1/2 of it.

I agree with you Carolyn. Also, Karen, if you work in the system, then you should know that rape is a serious and violent crime. Ask anyone who has experienced this and not seen justice done. I am sure that the victim and her family do not believe justice was fully served in this case either. By the way, the Judge halted the 3 year sentence because his crime was so bad. He ended up with six on the second plea deal with a strong admonishment from the judge.

Denial is what keeps most people and criminals from change even if they are prayed for. That will be the first step in Sam Nesis' recovery, if and only if he takes responsibility for his actions instead of refusing to truly admit his guilt. He obviously has deceived himself.

I agree, the courts are way too lenient on "first" time offenders of a younger age and that only half the truth is told on some of these deals that get worked out. That is how Marcy's law came about and in some ways was at work in this case when the Judge turned down the original plea deal. She obviously had serious concerns and even said so!

If Sam Nesis doesn't change his life, he will repeat this type of criminal behavior. His mind is sick and depraved. That is what makes a rapist. I , too, have worked within the system and have seen the fall out too many times. Sadly, it is very difficult to treat a rapist. They usually repeat and go on to worse crimes. That is partially why they must be registered as sex offenders. Megan's Law brought that about. These stories of leniency are repeated over and over.

It is a sad fact of our society today that the courts and prisons are so overloaded that many criminals are able to fall through the cracks. Remember the Jaycee Duggard story? Her rapist and kidnapper fell through the cracks of a very weakened system. That is my humble opinion. Sadly, many criminals walk our streets and then we want to blame the parents or the victims if they fall prey to such an individual. Karen, you victimize the victim again by your comment without knowing all of the truth yourself!
