Assembly election: Bauer-Kahan jumps ahead to 2,500-vote lead; Baker concedes

Democrat Rebecca Bauer-Kahan has declared victory in the District 16 election after a concession call from Republican Assemblywoman Catharine Baker in the wake of the challenger leapfrogging the incumbent to take a 2,513-vote lead after a large results update by Contra Costa County officials Friday afternoon.

I am an alumni of Santa Clara Law School, and am disgusted by the blatant fraud of Rebecca Bauer-Kahan in claiming on the actual ballot, and in her campaign ads and bio, that she is a "Law Professor" at Santa Clara Law School. She has NEVER been a "Professor" at Santa Clara Law School.

Being an actual "Professor" carries the prestige and recognition that the university has granted actual "Professor" status, rather than "Lecturer" or "Adjunct Professor" that is used for those who may teach a temporary seminar or part time class like research and writing. Anyone associated with a university fully understands this distinction, and for her to fraudulently hold herself out on the actual ballot and campaign ads and brochure as a "Professor" at Santa Clara Law School is false, fraudulent, and shows her complete lack of character. It is an insult to those individuals who have spent years putting in the hard work and effort in publishing and teaching to be awarded actual "Professor" status, for her to falsely claim she is a "Professor" when she is not.

She has lost the respect of attorneys and those in academia, and I am requesting that she immediately resign and allow the Governor to appoint a replacement who has not committed fraud and got elected by lying about being a "Professor" at Santa Clara Law School. This is not a partisan issue, it is a ethics issue, and he can appoint a Democrat to take her place, a Democrat who has not committed fraud in getting elected.

Hmmmm...I hope these weren't ballots found at the last minute,that all happened to be Democrat votes....many with just 1-vote in the entire ballot, to make the swing happened in Florida, were boxes of ballots mysteriously showed up after the fact.

Fraud: I am a member of the CA Bar, and I respect Ms. Bauer-Kahan. Your screed, verbatim from the last week's tantrum-on-the-square, is much ado about nothing. But at least you left out the silliness about seven years of legal practice not supporting a campaign claim that she's an 'experienced attorney.' You need some new material.

Ms. Baker was a well-organized public servant, whose views were too conservative for her district. Presumably, she'll now go back to being an 'experienced attorney.'

Thibx: I cannot speak for others, but I grow increasingly impatient with these scurrilous, Sore-Loser innuendos that are utterly without basis in fact. They are corrosive to the small-d-democratic institutions on which we rely - bring your best actual evidence of fraud in this election, or knock it off - your candidate lost. And say, what about that rumor I heard that you stick pins in kittens? Maybe it's not true - but it could be, right?

I'm going to reserve my opinion to see if her feedback to her constituents is up to the standard Ms Baker has followed during her term. Will she be open and free with what's happening in the legislature including community meetings to receive feedback, or will she simply accept her wages, enjoy the perks and plan for reelection like previous democrats. Ms Baker was doing and fine job and our new rep has a lot to do to meet the standard set in recent years.

Facts matter - except to Leftists. Make sure you tell your kids "even though that candidate (insert Leftist candidate name) LIED, I voted for them anyway." Never forget that at least half of all LEGAL Americans believe that you and your "feelings over facts" ilk are exactly what is wrong with America today.

Danvillain - if you deny that Bauer-Kahan was purposely misrepresented Baker's positions, actual accomplishments, and voting record many times, which were outright lies vs. just the same ole' "political gamesmanship" that might be otherwise expected, you are just too far into the bag for your party. That a center-moderate Republican like Baker with an impeccable record of accomplishment and heavily covered bi-partisan outreach, and even endorsement support from the left-leaning print media (of all sources) cannot get re-elected in our now 50-50 district is highly disturbing. That, plus Orange County going 100% blue for Congress just means this State is continually heading in the wrong direction politically to its detriment. All of which will cause more exodus of rational, responsible, conservative, and accurate thinking individuals that will further erode the ability for any Republican to get elected here to represent something other than progressive statist tyranny. I'm sure that is joyful news to you, but you'll end up footing the bill for all the misguided policies now and going forward.

Assemblywoman Baker would have received my vote again, even as a Democrat. She made great appearances seeming to do everything right. But, fortunately, I took the time to look at her voting record some time ago and was shocked. There was not much bipartisanship there. A wolf in sheep’s clothing for this Drmocrat. Thanks for your service Assemblywoman Baker, but no thanks for your voting record. Apparently I’m not the only Democrat who figured you out!

@ HennyMatty: I do not recognize anything I wrote in your tired, out-of-date jeremiad. Let's take stock of all that irresponsible spending by the super-majority Dems ... oh wait, there's a big fiscal surplus and a $16 Billion rainy day fund, you say? How'd THAT happen?

I don't agree with everything, including the high-speed train. But I am very happy with where CA sits on the environment/warming, state-level equality, infrastructure etc.

OTOH, the GOP lost Orange County precisely because of that federal rich-man's tax cut that specifically screwed Californians and is ballooning the deficit and national debt that you-all pretend to care about. Web Link The economy is on a sugar-high as a result, precisely when fiscal policy ought to be moderating it. The problem with artificial highs is that they exacerbate the lows to come - for no good economic reason. Whom will you blame then?

Danvillian, this is not a partisan attack based on her political party. As I noted, the Governor should appoint a Democrat to take her place since she committed outright fraud on the actual ballot, lying that she was a Professor when she was not. You lose all credibility when you simply refer to it as "mild puffery". If you are actually an attorney, you are aware that we are required to follow certain ethical canons, and in fact this very month our State Bar came out with new required ethical canons. Lying on an actual ballot about your profession violates numerous required ethical rules, and thus she should resign.

If we can not trust her to simply tell the truth about her profession on the actual ballot, how are we suppose to trust her to represent her constituents in an ethical and honest manner?

Danvillian, I suggest you contact the actual "Professors" at whatever law school you attended and ask them if it is "mild puffery" to claim on the actual ballot you are a professor when in fact you have never been a professor. Ask them if this bothers them. Chances are, your law school "professors", especially if you attended in California, are Democrats, and it will still greatly bother them. Actual "Professors", who have spent years publishing and teaching to earn the actual recognition from the University as "Professor", do not take kindly those lying about being Professors when they are not.

She has not even been sworn in yet as my representative and she is already committing fraud. Shame on her, and shame on those like Danvillian who put political party over ethics.

I am very saddened to hear of Catharine Baker’s loss. To me she is one of the very few ethical, bi-partisan, hard working politicians. She listened to both sides of every issue and then made her decision, not just following the party line. My hope is that she goes onto a bigger and more influential political position.

Yes! And with a 'fraud' That Serious, you can bet that those Santa Clara law profs have put together a letter of objection - kind of like thousands of them did across the country in the Kavanaugh context.

Please supply us a copy of that letter - or at least the names of the professors you polled to reach your conclusion that they are shocked (Shocked!) and outraged. And whilst you're at it, howsabout a list of all the members of the legal community you polled to conclude that The Bar has lost all respect for her.

Take your time. Make your case on the facts, counselor.

Danvillain - the surplus got that way due to overtaxation of state residents during a 2-year booming economy with more/higher/better incomes that had nothing to do with CA policy, THAT's How! And it only stayed as a surplus because Moonbeam didn't have a better idea on how to spend it right away on his way out. Don't worry, since Newsome will definitely find a way to spend it...especially now that the gas tax repeal failed due to misinformation and massive blue funding... and our roads/bridges/etc will still suck for Gavin McDreamy's entire term in office... We'll just wait and see how the road funds get diverted AGAIN after a few token projects. Amazing how the CA populace keeps getting duped by the proposition system...probably why it keeps getting used vs. actually passing legislation through the almost-super majority State legislature... ridiculous...

This is really a sad, tragic outcome for our district and our state. Catherine Baker was one of few competent people we had in our state legislature. I believe there is no greater force of evil in our nation than the Democratic Party. How any intelligent, educated, sane person could vote for a Democratic Party candidate is completely beyond my comprehension. The fact that our state is taken over by a political party that promotes division, hatred, racism and discrimination and prejudice is a too much to bear. Even our new Governor is a morally corrupt man who does not have an ounce of integrity in his entire body. God help us.

Henny-Matty: Amazing how mythology can overwhelm the inclination to actually pay attention to what's actually happening. Fortunately, the vast majority of your fellow citizens don't suffer from your studied blindness. Governor Brown has kept a tight rein on spending Throughout his 8 years in office - you should thank him, instead of dredging-up nonsense nicknames that seem to make you feel better.

Do you have Any Evidence that these gas tax funds have been/are being diverted? Bring it. There are about 400,000 miles of roads in California, and 500 bridges. They don't repair themselves - good on the Dems for raising necessary funds to address the problem - and making it a user fee - the electric cars can get a free pass, this time.

GOPers have been predicting sky-fall forever, and it never happens. Maybe they need a new prognosticator. In the meantime, enjoy your third-party status.

What has happened in Florida, Georgia, and California recently is appalling. Regardless of which party you favor, you have to question the integrity of our voting system. Hopefully, history will not repeat itself. Please look up the Battle of Athens to see what happened in Tennessee in 1946 (see link Web Link

If San Francisco is a microcosm of how our super majority will run the entire state, we are all in trouble (street people, needles, drugs, crime). As for the claim of a state surplus, you might want to look beyond the headlines as we have somewhere on the neighborhood of 170 to 200 Billion of underfunded pension liability.

The Democrats takeover of the state has been well planned. Jerry Brown and friends were able to put legislation in place for illegals to get CA driver's licenses. A couple of years later, anyone with a CA driver's license was registered to vote without any oversite whether they are actually citizens or have the legal right to vote. While we all like the absentee ballot system, it opens the door for significant fraud. In a democracy, every LEGITIMATE vote should count.

Like many other baby boomers, I have bought out of state and have an exit strategy in place. The state can take my tax money now, but they aren't going to get any of my 401K or IRA money!!

As for those who talk about sore losers, when will the Democrats and media admit that Trump won the residential election a couple of years ago??

Henny-Matty: Don't waste our time.

Your link 1 is a UCLA research paper that recommends gas excise taxes as better than sales taxes because they are a more stable revenue source for long-term transportation projects. That's probably right, but it says Nothing about the total spent nor about any diversion of the 2017 gas tax increase to other uses.

Your link 2 is an OpEd that was written before the current tax Even Became Effective - it's by a failed one-term city councilman who ran unsuccessfully: for Mayor (2012) for the House (2014) and for the House from another district (dropped-out early, 2018). He caught on with the group trying to repeal the tax. It predicts all manner of evil - which has not materialized. Predictions aren't evidence, especially when they do not happen.

Your link 3 is an OpEd screed from the far-right Orange County Register, written in January 2018 where even the headline is Stated in The Conditional: "Paying more at the pump will not fix California’s roads IF politicians keep raiding the gas-tax fund." Writer goes on to have many unrelated complaints, including that "A decade ago, [GOP] Gov. Arnold Schwarzenegger wanted to use $1.1 billion in Public Transportation Account ..." and the legislature went along. There is sweet ... nothing about any diversion of the new gas tax. Nothing. BTW, even Orange County went blue in this month's elections. Very blue.

The One Thing most Americans can agree-on is that infra-structure Urgently needs attention. So California goes ahead and does something significant while the GOP-'led' feds dither their majorities, and you don't like it because it was Democrat-led. You might better complain about how the GOP tax bill specifically screwed Californians. That state tax deduction cap will likely cost you a LOT more than a few cents a gas gallon - and for nothing.

Danvillain - whatever joke or reference you are attempting by responding to me as "Henny-Matty" is lost on whatever...

Almost every article found mentioning, ripping, defending or even attempting to debunk CA gas tax funds diversion is an OpEd (or should be so declared), so it is too convenient to just not consider any of the historical facts cited in the ones I presented isn't it? I could rip all the Lib articles in the same vain due to their authors/papers, but that would continue to "waste your time".

Leaving my quick search non-OpEd sources to just Article 1 from UCLA- Quote " The state began diverting fuel sales tax money previously earmarked for mass transit to pay debt from highway and rail bonds, as well as GENERAL SERVICES supported by the state."

The fact is that diversion HAS happened with PREVIOUS gas sales tax funds, and could well happen again despite Prop 69 supposedly protecting from diverting these types of funds. The way Brownie wrote the gas tax bill, it is specifically written to allow the governor to transfer the funds to cover General Fund shortfalls without a vote of the legislature or the people. When you see a state highway or state-owned road actually fixed/improved in the next 5 years, please post here with pictures...

On your other topic, was I happy about the Fed Income Tax state/property tax write offs being limited to $10K? Hell no. Can you ask a more obtuse question? That is a separate issue at a different level where we even have less control than here in-State where the Gas Tax Repeal prop should have been voted into law. Trump's personal income tax changes were clearly a political move against the high tax coastal states who don't vote red for national offices anyway, so his risk in doing it was low. Lower income non-home owning Californians probably do better under it with the larger standard deduction, but it sucks for us Danville-area home owners for sure.

The only hope I have for you is that you recognize that the bullet train project is a money sucking loser that we need to repeal as well. We can only dream...

So to summarize, Henny, you have NO evidence of Any current diversions. Period. You only have evidence of Past diversions as requested by the GOP Governor Arnold (for starved social programs in the Great Recession, to be fair), with the legislature's acquiescence.

All you have is suspicion - but it Might Happen!! Yeah, and, of course, The Sky Might be Falling!!

So, once again - don't waste our time.

However, if you Really want to consider an Actual case of government actually screwing the taxpayers, the Trump tax 'cut' is actual Exhibit A. Remember this exchange next April, Henny.

Danvillain - Nice try... I was clear during my entire thread that PREVIOUS gas tax funds have been diverted. You disputed, and I proved they had been with references when challenged for them. Your lame attempt at spin to say my claim was one of CURRENT diversion of gas tax funds for a law that hasn't been in effect long enough to be audited let alone corrupted yet (it just started July/2019), and you think you won the point? Wrong, sir. The same history of funds diversion can be said of CA Lottery funds intended for CA schools, etc. The fact is that funds are consistently diverted in this State from their intended purposes that were voted into law, and this is another reason WHY Moonbeam had to go to the well again with his gas tax...Do I think that they MIGHT be diverted again, maybe or even likely...despite Prop 69, due to the HISTORY, yes they might. Regardless, we should not have needed THIS tax had PREVIOUS funds specified for road work from PREVIOUS gas taxes had not been diverted and instead put to use as intended.

Also, nice try to agitate me with the repeated references to Henny... Must be a funny, lonely, private joke in your little mind. Whatever. Now you have wasted enough of my time.
