Proclamations recognizing both SRVHS soccer teams and Asian American and Pacific Islander Heritage Month along with a range of town business items are among the topics on a crowded Danville Town Council agenda this week, as well as a vote on town action required in order to remove personal property from the owner of a vacant lot in the east of town.
The council is set to vote on a resolution that would declare the undeveloped site at the end of Pescadero Court to be a public nuisance, allowing the town to clear remaining property from the site following the departure of its owner in response to an abatement order earlier in the year.
“The Town cannot simply enter the property and remove the items without further process,” code enforcement officer Willard Scram wrote in a staff report.
“Although the Subject Property is open land, the owner retains a property interest in the items left behind, and removal without due process would implicate the owner’s rights under the Fourth and Fourteenth Amendments to the United States Constitution, as well as the requirements of DMC Section 1-6.3 and 1-6.4, which mandate a hearing before the Town Council prior to abatement by the Town,” he continued.
The town responded to complaints about the site in March, determining upon inspection that the property owner was occupying an active campsite on the parcel designated for drainage and flood control only along Green Valley Creek. The owner had vacated the property as of April 22, but left behind a number of items.
Those remaining items constitute a public nuisance according to town staff, who are recommending that the council approve an ordinance declaring the property as such and uphold an abatement notice issued last month, which would allow the town to remove the items if the owner fails to do so within 10 days of the council vote.
