An emergency ban on placing a medical marijuana dispensary in the Town of Danville has been extended out to an entire year, following action last week by the members of the Town Council.
At their Nov. 17 meeting, council members discussed the ban, which came about after property owners approached town staff with concerns that such a business was being considered. Under town statutes, the council is allowed to consider an emergency moratorium without going through the normal, sometimes lengthy, approval process.
As part of the resolution approved, the town has 45 days in which to approve an extension of the ban to a full year. Town Attorney Rob Ewing presented the original resolution to the council and at Tuesday’s meeting gave a brief update on the situation.
“The facts haven’t essentially changed since October,” Ewing said. “Our primary concern is we had people looking at opening such a business and we had nothing on the books to deal with it.”
One of the main issues facing California towns is that although medical marijuana dispensaries are legal in the state, the federal ruling is that they are illegal. Some towns have already filed suit to either remove an already existing facility or prevent a new one from being sited.
Ewing said extending the ban would allow the town to see how the already existing lawsuits are resolved, which would give them a sense of how any attempt on their part to ban or regulate a medical marijuana dispensary would be received.
As part of his update, Ewing pointed out that state legislation that may be coming out that will deal with the issue, although he said he wasn’t certain what it will do or how it will be accomplished.
Council members discussed the extension briefly, before giving it unanimous approval.

It is interesting that those against medical cannabis are suffering the most paranoia. That was a bit of legalization humor.
Change is hard. I know this.
Medical cannabis people are people. We need to show compassion like Jesus would and allow access to medical Cannabis in California in my opinion.
Who are you kidding? There are Dr.’s out there who will write prescriptions to just about anyone. What we don’t need is to have marijuana more readily accesible to the youth in our commuity. The pot use in our local high schools is out of control. If these kids can outsmart our local police and school adminstrators, they certainly can figure out a way to purchase their medical marijuana (possibly with the help of an adult). It is a proven fact, marijuana is harmful to our youth and their developing brains. Why bring this element into our community and heighten the risk?
Just another brain dead decision by the Danville Town Council. It will never change if you keep electing weak minded automaton’s.

I’m not surprised with the lack of vision the Danville council expressed…visionary’s are something in the past. The only time a person with a vision is successful is when he/she acts separately. If any of you have ever been a juror, you know what I’m saying. Sheep are a dime a dozen..it’s the visionary that changes things, but it’s also the visionary that gets all the crap thrown at him/her.
Oh well, that’s life in Danville and sadly speaking, most everywhere else.

The real scourge upon our community is allowing more boutique stores.
Think of all those, esp. in this season, suffering from compulsive shopping and overspending.
A year moratorium would go a long way to helping these people get through their crisis time.

Need to hear from those that really do need these dispensaries. I have no idea of what you’re going through. Lot of us don’t know your pain. How does this help you? I’m not against it or for it yet. I’ve heard why not to have it……but really if it makes a big difference for you then I’m for it. BTW, how do we keep it from those who do not have a need for it?
Hmmm, a ban on a drug outlet supported by Federal Law. How strange the liberals are to not support the Council. Seems like everything that is good and decent, the liberals want to tear it down. Could they ever consider that a illegal drug outlet sends the wrong message to children ?
