The city of San Ramon’s Building Division is set to continue under its previous leader on an interim basis following his retirement earlier this month, with the City Council poised for a vote on returning him to duty in order to comply with state law.

Vancel Phillips retired from his position as division manager for the city’s Building Division effective July 12, but could be returning to action starting this week after the council’s vote on appointing him back to the role as they search for his replacement.

According to a staff report by Community Development Director Debbie Chamberlain, the city is required by the state to “always maintain a Chief Building Official on staff,” with city staff now requesting an exception to the 180-day waiting period for beneficiaries of the state’s public retirement agency to accept temporary employment following retirement.

Recruitment for Phillips’ successor kicked off following his retirement announcement at the end of May, with that process still underway through his last day on the job.

“Temporarily appointing Mr. Phillips to the position will allow coverage of the day-to-day operations of the Building and Safety Division while the City completes the recruitment and selection process for a new permanent Chief Building Official,” Chamberlain wrote. “Typically, the recruitment and selection process occurs over several months.”

Chamberlain noted that exceptions to the 180-day waiting period are allowed under state law if it is determined “that the appointment is necessary to fill a critical need before 180 days have passed,” and that the appointment is approved by the council at a public meeting.

Phillips is agreeable to the proposed interim role according to Chamberlain. Under the terms of the contract, his employment could be terminated by either party at any point, but it is set to expire by Dec. 30 or when his replacement is appointed, whichever comes first.
