The Danville Town Council is set to consider appointing five new volunteers to the currently non-functioning board of the Magee Ranch Geologic Hazard Abatement District with the goal of reviving the body at the request of the neighborhood’s HOA.
The district and its board of directors were founded in 1992, at which point the town council voted to approve the formation of the district and appointed five property owners to serve on the board. Later that year, the council voted to appoint two replacement directors.
“Subsequent to these actions, the Town has had no need to interact with the GHAD,” City Attorney Robert Ewing wrote in a staff report.
Ewing noted that Magee Ranch is the only stand-alone geologic hazard abatement district in the town, with more recent developments being annexed into existing GHADs within the county, thereby not requiring any action by the town.
In the more than 30 years since the Magee Ranch district was established, the board has never performed its function according to Ewing, a matter that was brought to the town’s attention by the Magee Ranch HOA earlier this year.
“The Board of Directors of the Magee Ranch GHAD never functioned or operated and the Board members previously appointed are no longer able to serve, so no action can be taken to get the GHAD back on track,” Ewing said.
Ewing and the attorney representing the Magee Ranch HOA have concluded that the best way to address the issue is to appoint five new members to the board, with the HOA having provided a list of five volunteers recommended for appointment.
“Once that is done, they will be able to take the steps needed to update their plan of control and any other necessary actions to make the GHAD operational,” Ewing wrote.”Taking this action does not obligate the Town to do anything else with respect to the GHAD nor create any financial obligations. It simply allows them to get their house in order.”
