A jury trial in the criminal case against former San Ramon Valley biology teacher and cheer coach Nicholas Moseby — in which he is facing multiple felony and misdemeanor charges for allegations of sexual abuse and harassment involving minors — is now set to begin this summer following a second delay that has led the trial to be rescheduled.

The trial is now set to kick off on June 24 at 8:30 a.m. after the previously scheduled start date on March 18 was vacated. The initially planned start date this month interfered with other trials that both the judge in the Moseby case and Moseby’s attorneys were involved in, according to a spokesperson for the Contra Costa County District Attorney’s office.

After being taken into custody on criminal charges brought forward by the DA’s office in September 2022, Moseby was released on bond that December. He has pleaded not guilty to the four felony counts and three misdemeanor counts he is currently facing. 

Since Moseby’s initial arrest more than a year ago, additional alleged victims have come forward, leading to more charges similar to those he was first arrested for in 2022.

The latest postponement of the jury trial in Moseby’s case is the second so far, with the trial previously having been scheduled for last November before being pushed up to this month then delayed again this week.

  1. Further delay in the Moseby trial was to be expected, once SRVUSD placed its two parcel-tax increases on a May 7th special vote-by-mail ballot, at approximate extra cost of $1,000,000.

    Measure E would renew the existing $144 parcel tax, but add a sneaky inflation factor every year during Measure E’s nine-year run, based on a federal CPI index for this area. The District’s tax promoters evidently realize the inflator clause is a problem; they studiously avoid mentioning it in their ballot arguments, instead saying (misleadingly) that it’s “not a new tax.”

    Measure F would add a flat $98 to the $144 and its annual inflator.

    The last thing SRVUSD would want is the notoriety of the Nicholas Moseby allegations playing out in court just before their special election. For those who forget: Moseby was initially at SRV High. But high school girls at SRV High reported Moseby comments that made them uncomfortable.

    So SRVUSD moved him to Diablo Vista MIDDLE School (!), where serious criminal charges were then alleged. If there was such bad judgment as to place Moseby among younger girls, one would think that institutional memory of some sort would at least have found a different new venue to be victimized. Diablo Vista was where teacher Mitchell Wolf was a teacher. He pled guilty to child pornography possession in 2015 ( https://www.danvillesanramon.com/news/2015/07/09/former-danville-teacher-pleads-guilty-to-child-pornography-possession ).

    Atop SRVUSD’s dangerous irresponsibility, SRV High “lost” the original Moseby complaint records there. So again: no surprise that things have been arranged to try Moseby (arrested last September) in June, instead of March, with the District’s tax measures on the vote-by-mail ballot in May.
