The Danville Town Council is set to resume discussions this week on how – or whether – to continue to allow outdoor dining options that proliferated during the early days of the COVID-19 pandemic and remain popular among downtown businesses in the present day.
Town staff are set to provide an update at the council’s upcoming study session, following direction from a previous study session on the topic in June.
While councilmembers are seeking to establish a permanent program to allow for the continuation of parklets, they indicated in June that the town would be putting an end to the expanded outdoor dining program.
With expanded outdoor dining regulations poised to expire in January, outdoor seating is set to be subject to a number of new requirements, including an in-lieu fee for outdoor dining areas that are more than 25% of restaurants’ interior dining areas and a custom design requirement for seating.
The council is also seeking to add new restrictions to parklets in addition to the lease agreement and payment requirement already in place. That includes provisions to account for steps that could result in the removal of the structures if the owner has not made lease payments, to void permits that have been issued if a parklet remains inactive for more than six months, and an administrative fee.
The permanent parklet regulations taking shape would also impact the development of new parklets, with parklets overall in the downtown neighborhood restricted to a total of 12 parking spaces. That means a new parklet could only be established following the removal of an existing one, and that it could not exceed its size.
The upcoming study session is set to be informational only, with any final changes poised to come back as action items at future Planning Commission and regular Town Council meetings.
